Mondays' Motion Day 11-9-09


11-9-09: Blawg Review #237 Hosted by England's The Property Law Blog. This week's Blawg Review is, again, well worth the read, and the links. Christian Metcalfe themes BR #237 after the Putney Debates, "a series of debates which took place at the end of the first English Civil War in a church in Putney from 28 October to 11 November 1647, with some breaks for vigorous helmet polishing and pike waving."
With an understandably heavy dose of the UK, BR #237 brings links ranging from the Above The Law lawsuit brought, then dismissed, by Prof. Jones of Univ. of Miami to the Bitter Lawyer's railing of "whiny pussies" (associates that "cry out for work/life balance while earning $185k a year"). However, many of the links do lead to the wrong site, so do a little leg work and don't complain. With such voluminous coverage, & after having hosted BR myself, I understand. It's hard out here for a pimp.

11-7-09: "Bucky" Is Gone!! On Saturday, James "Bucky" Buchanan, our loyal friend and popular colleague, had a heart attack while driving his Ferrari. He hit a wall and was killed at age 74, which he showed was still a young age. The city and state has lost one of our greats. Bucky never met a paying client he didn't like, only because he always gave the system respect and his he always gave his clients a fighting chance. Rest well Bucky . . . (LVRJ/LVSun)

11-3-09:
Local Attorney Duensing Tased & Shot: Wild Wild Law gave us the best follow up and commentary from the local law scene on the Metro Police tasing and shooting of local attorney Duensing. See HERE & HERE. However the Comments on there story were quite ignorant, click HERE. A lot of assumptions, a lot of generalizations, like he should have been shot. People! That is the last resort. We commented on it, too, HERE. Other than us and a few Libertarian sites, only the news outlets followed this story. (LVRJ)

No, he should not have been tased. No, he should not have been shot. You can also see his alleged side of the story HERE. I think this is typical Metro and is becoming more and more common. I know he was more dangerous than the little, Spanish-Speaking mother running an ice cream truck that Henderson Police shot and killed, but shooting him 'in the back'? According to witnesses he was just running and did not pull out a gun or even reach for one. Was the Metro Officer too fat? What could possibly have been the reason? That is a new low, even for Metro.

11-5-05 : What About Practicing Law Without A License, AGAIN? Who you say, you know, Charles Radosevich, disbarred attorney. Hopefully this activity does not draw the same violent ire of Metro. This story has gotten some serious play this last week, from us HERE and from the LVSun (Nov. 5). I believe WWL chimed in too with more silly Comments from the Legal Herd. Though, it seems that Metro did not investigate Radosevich until the LVSun (Nov. 1) reported the matter last Sunday. Even though the State Bar of Nevada reported this activity to Metro several times they appear to have just let it go. So who has more clout with Metro? the LVSun or the State Bar of Nevada. Easy, the one the prints newspaper daily. The result, felony charges and a $200 undercover sting operation that resulted 2 misdemeanor citations. WooHoo!

11-6-09: EDCR 7.72 Means NO Girls In Skirts? "Suitable Dresses or Pantsuits ONLY" in Las Vegas Courts?

Anonymous: What stands out to me most on the topic of attorney attire is that (private) criminal defense attorneys seems to go out of their way to have "anti-establishment" hair, clothes and shoes.

Anonymous: I LOVE being a female attorney in court. You apparently no longer have to wear a suit. In fact, based on what my peers are wearing, the only thing off limits is pajamas. I've seen leather, low-cut, sleeveless, hooker shoes, and all of the above combined on one person. I used to debate whether dresses were unprofessional. Anything goes.

And in family court, well, pajamas are probably okay there.

Anonymous: A female attorney in town actually showed up at court for the announcement of a verdict (In a case where she was one of the lead attorneys) in a pair of sweatpants - she has a jury out, knows she's going to get called back sooner or later and didn't even bother to keep a decent suit in her office.

Anonymous: I am shocked to learn that attorneys do not uniformly conform to the mandates of EDCR 7.72. "All persons appearing in open court must be properly attired as benefits the dignity of the court. All male attorneys must wear full length trousers, coat and tie; female attorneys must wear suitable dresses or pantsuits."

Since when have 'skirts' been allowed in Court. They're not. If the boys no longer get the "jackets optional" rule in the summer, the girls should be forced to wear 'dresses' or 'pantsuits', all the time. I agree with the pajamas comments, it is getting out of control, but no one will do anything about it. We claim 'oppression' about everything!!
11-1-09: Anti-UNR Corruption Rally Goes Forward, Like We Said. We mentioned this before, HERE. They are seeking to get a grand jury to hear about the the corruption. Who is 'they'? Well, not a bunch of disgruntled students. See HERE. UNR professors, coaches & other insiders that allegedly know that there is some serious problems with the way things are run, even campus police cover ups. You know how I hate that. It is clear what the public thinks, come on judge, let the grand jury take a look at it. Why wouldn't you investigate it? Oh yea, maybe you are part of it. We'll see where the judge stands.

I've been reading a fascinating book called The Cousins' Wars by Kevin Phillips. It looks at the English Civil War, the American Revolution, and the American Civil War, and he makes a compelling case for how linked the conflicts actually were. I highly recommend it, and I love the podcast. I'm eagerly awaiting your next opus, so from the Windy City, cheers.
